Marcos Penaloza, 29, was charged with fourth-degree stalking, a misdemeanor.

Police say the girlfriend, who is also from Port Chester,  fled to her mother's home around 5 a.m. on Nov. 1 because she had argued with Penaloza and feared he would hurt their child, Tarrytown police said.

When the woman arrived at her mother's home, her boyfriend and sister drove up and the argument continued, police said. The woman then locked herself in her car and called 911, police said.

Penaloza admitted punching out the rear and side windows of the car he arrived in, saying he was angry that his girlfriend had left with his child, police said.
