The railroad company issued disciplinary charges against the employee after he reported the injury and further charges after he filed an anti-discrimination complaint with the Occupational Safety and Health Administration in 2012, according to the Westchester Business Journal, which said unofficial reports from other employees indicate some workers were discouraged from reporting injuries and poor safety conditions.
The $250,000 fine in punitive damages is the maximum allowed by law, according to the Business Journal. The company is also responsible for paying $10,000 in compensatory damages and covering attorney fees, The Business Journal reports.
