Prosecutor says sex offender who molested boy ‘still aroused’ by it

ONLY ON CVP: A Paterson man caught molesting a boy on his then-wife’s birthday “still gets aroused when he thinks about it,” a prosecutor told a sentencing judge in Hackensack.

Frederick L. Pate, 43, was headed to the Adult Diagnostic and Treatment Center in Avenel, rather than to prison, at his own request.

Although sentenced to 13 years – eleven of which he must serve before being eligible for parole – Pate could end up spending more time at the secure treatment center than if he’d been sent to a correctional facility.

Offenders can be held indefinitely at the ADTC if deemed an ongoing risk to sexually abuse anyone else.

“He could do more time at Avenel,” defense attorney Robert Gallucio conceded. “But he needs treatment.”

“The doctors say he needs treatment, he wants treatment,” the lawyer told Presiding Superior Court Judge Liliana DeAvila-Silebi in Hackensack last week.

To his credit, Pate took responsibility for his actions, sparing the youth the ordeal of a trial, Assistant Bergen County Prosecutor Kristin DeMarco said.

His acts were “clearly very disturbing,” she told the judge. “He told investigators: ‘I didn’t think about it, but after it happened I thought about it all the time.’ He said he still gets aroused when he thinks about it.”

Pate – also known as Allen Steele – already had an extensive criminal record, including arrests in Passaic County for drugs, robbery, burglary, theft and obstruction, DeMarco said.

He previously pleaded guilty to two first-degree charges of sexual assaulting the boy, as well as to a third-degree charge of sexual conduct to impair or debauch the morals of a child.

Under the sentence imposed by DeAvila-Silebi, he is subject to Megan’s Law lifetime parole supervision upon release and must provide a DNA sample.

The 651 days that Pate has spent behind bars since his arrest nearly two years ago could come off his sentence if his sex offender treatment is successful.
